Privacy Notice for the Protection of Personal Data

MISION KATERI, ASOCIACION CIVIL (hereinafter Misión Kateri) with address at Avenida Colonizador No. 71-A, Colonia Las Quintas, C.P. 83240, Hermosillo, Sonora, Mexico, is responsible for the use and protection of your personal data, therefore, in order to comply with the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, and the Guidelines issued by the National Institute of Transparency, Access to Information and Protection of Personal Data, (hereinafter the "Applicable Legislation"), you are informed of the following:

First. Definitions.

The terms used in this Privacy Notice shall have the meaning assigned by the Applicable Legislation.

Second. Availability of the Privacy Notice.

Misión Kateri collects personal data personally and indirectly through its website, so it makes this privacy notice available to you, which can be consulted at the electronic address: www.misionkateri.org.

The Data Subject will be considered to have given consent for the use and processing of their personal data after 5 (five) business days from the moment the Notice was made available to them, without having expressed opposition.

If within the period referred to in the preceding paragraph, the Data Subject opposes the processing of their personal data, the Data Controller must immediately delete any personal data it has collected from the Data Subject and refrain from using it.

Third. Purposes.

The personal data collected by Misión Kateri is used for the following purposes:

Employee Data: understood as persons with whom Misión Kateri has an employer-employee relationship.

Donor Data: understood as persons who make a donation in money or in kind.

  1. To confirm their identity and verify that they are not on the list published by the Tax Administration Service referring to Article 69-B of the Fiscal Code of the Federation.
  2. To issue the corresponding tax-deductible receipt.

Supplier Data: understood as persons who sell an asset or provide a service to Misión Kateri.

  1. To make the corresponding payments.

Website User Data: understood as persons who access the Misión Kateri site www.misionkateri.org.

  1. To send informative newsletters.

You may refuse the processing of your personal data for these latter purposes by indicating your refusal in the following box or by sending an email to the following email address: info@misionkateri.org, expressing your refusal for such processing.

  • I do not accept the processing of my personal data for the secondary purposes specified above.

Fourth. Personal data we collect.

To carry out the purposes described in the preceding clause, Misión Kateri collects the following personal data:

a) Employees:

Identification data, which include: full name, age, marital status, handwritten signature, Federal Taxpayer Registry, Unique Population Registry Code, Social Security Number, place and date of birth, nationality.

Contact data: home address, cell phone number, and personal email address.

Financial data, which include: tax information and bank accounts.

Employment data: including workplaces, positions held, experience, and employment references.

Academic data: including degree titles, professional license, certifications, recognitions.

b) Donors:

Identification data, which include: full name, age, marital status, handwritten signature, Federal Taxpayer ID, Social Security Number, place and date of birth, nationality.

c) Suppliers:

Contact data: home address, cell phone number, and personal email address.

Financial data, including: tax information and bank accounts.

d) Website users:

Contact data: name and personal email address.

The personal data of the Data Subject may be collected by Misión Kateri in different ways, such as: (i) when the Data Subject directly provides the information through filling out forms; (ii) when the Data Subject visits Misión Kateri's website and wants to make an online donation and (iii) when personal data is obtained indirectly through other sources that are permitted by Applicable Legislation.

Fifth. Rights of Access, Rectification, Cancellation, and Opposition (ARCO).

The Data Subject may exercise at any time, personally or through a legal representative, their rights of Access, Rectification, Cancellation, and/or Opposition (hereinafter "ARCO Rights") regarding the processing that Misión Kateri is giving to their personal data.

ARCO Rights include the powers to access their personal data and the details of its processing; rectify them if they are inaccurate, incorrect, incomplete; cancel them when considered no longer necessary because the purpose for which they were collected has ended, or oppose the processing of the same for one or more of the purposes established in the Notice.

The exercise of ARCO Rights will be done through a written and signed request that meets the following requirements: it must be physically presented at our offices or sent by email to the following address: info@misionkateri.org

It must contain at least the following requirements:

I. Name of the data subject, address or email to receive the response.
II. Documents that prove their identity.
III. Description of the right to be exercised, as well as the request regarding that right; in the case of the right of rectification, the incorrect or inaccurate data and the modifications to be made must be indicated.
IV. Any other means that allows, if applicable, to locate said data.

The request may be submitted by a representative, provided that they prove their personality, which can be accredited by a simple Power of Attorney granted before two witnesses, including the corresponding identifications of the Data Subject, attorney-in-fact, and witnesses before whom the power is granted.

If your request is presented at our offices, we will stamp a copy of it, which you must keep as a Receipt. If the ARCO Rights request is sent by email, once we have received it, we will proceed to confirm receipt by the same means, which will serve as a Receipt, without such confirmation implying that your request is appropriate or that it has been resolved.

Once your ARCO rights exercise request is received, it will be analyzed, and if there are inaccuracies, the required documentation was not attached, or if Misión Kateri requires more information to respond to your request, we will communicate this to you within a maximum period of five business days from the date we received your request and we will grant you a period of ten days to correct the irregularities or present the complementary information. If you do not correct the omissions within the aforementioned period, the request will be considered as not submitted.

If the request has all the elements to be able to resolve it, the response will be communicated by the means you have indicated in your request, within a period that should not exceed 20 (twenty) business days.

Sixth. Transfer of Personal Data.

We inform you that Misión Kateri does not transfer the personal data it collects to any other individual.

Seventh. Limitation on the use or disclosure of Personal Data.

The personal data of the Data Subject will be kept in strict confidentiality in accordance with the Applicable Legislation, under the administrative and technical systems that Misión Kateri implements for this purpose. The protection of the personal data of the Data Subject will be against any damage, loss, destruction and unauthorized use, access and treatment. In order for you to limit the use and disclosure of your personal information, we offer you the following means:

  • Your registration in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Protection Agency, with the purpose that your personal data is not used to receive advertising or promotions from companies of goods or services. For more information about this registry, you can consult the PROFECO Internet portal, or contact them directly.

Eighth. Revocation of authorization to process personal data.

The Data Subject may revoke their consent for the processing of their personal data, following the procedure mentioned below.

In case the law obliges Misión Kateri to preserve the personal data, the revocation request will not be appropriate, so Misión Kateri will inform the corresponding legal reasons.

To revoke your consent, you must submit your request at Misión Kateri's address or send your request via email to info@misionkateri.org

The procedure and requirements for the revocation of consent are as follows:

  1. Submit your request expressing your will to revoke the consent you granted to Misión Kateri for the processing of personal data.
  2. Once the request is received, Misión Kateri will have a period of 20 business days to inform the data subject of the date on which they can come to have the collected personal data returned and will indicate whether it can legally proceed or not with its destruction.

Ninth. Veracity of the data provided by the Data Subject.

The Data Subject guarantees that the personal data provided is true and is responsible for communicating to Misión Kateri any modification thereof. The Data Subject will be responsible, in any case, for the veracity of the data provided, reserving Misión Kateri the right to exclude the Data Subject who has given false data, without prejudice to other actions that may proceed in law.

Tenth. Security Measures.

Misión Kateri has established and maintains security measures, administrative and physical, that allow it to protect your personal data against damage, loss, destruction or against unauthorized use, access or treatment, in terms of applicable legislation.

Eleventh. Acceptance and consent.

The Data Subject declares to have been informed of the conditions on personal data protection, accepting and consenting to the processing of these by Misión Kateri, in the manner and for the purposes indicated in this Privacy Notice.
